Exkurs: Der geplatzte \u201ePrivacy Shield\u201c-Deal und die Datenschutz-Grundverordnung<\/h1><\/div><\/div>[\/vc_column][vc_column][vc_column_text]<\/p>\r\n

Datenschutz-Grundverordnung:<\/strong><\/h4>\r\n

Die DSGVO<\/a> verbietet die Verarbeitung personenbezogener Daten au\u00dferhalb der Europ\u00e4ischen Union, wenn im Ausland kein angemessenes Datenschutzniveau herrscht. Dies ist vor allem in den USA der Fall.<\/p>\r\n

Stellte der Europ\u00e4ische Gerichtshof also erst ein angemessenes Datenschutzniveau fest \u2013 vorausgesetzt, US-Unternehmen verpflichteten sich das EU-Recht auf Grundlage des\u00a0\u201ePrivacy Shield\u201c-Deals zu wahren \u2013, ist diese Grundlage f\u00fcr Datentransfers nun unwirksam<\/a>.<\/p>\r\n

 <\/p>\r\n

Standardvertragsklauseln:<\/strong><\/h4>\r\n

Die vorgefertigten und als Standardvertrags- oder Schutzklauseln (Standard Contractual Clauses<\/em>, SCCs) bezeichneten Vertragsvorlagen verpflichten -partner zur Einhaltung des Europ\u00e4ischen Datenschutzniveaus. Allerdings erlauben sie Daten\u00fcbertragungen nur, wenn beide Partner den Datenschutz auch tats\u00e4chlich wahren. So w\u00e4ren das \u201ePrivacy Shield\u201c-Abkommen und die Standartschutzklauseln als Grundlage f\u00fcr EU-US-Datentransfers zul\u00e4ssig, wenn die USA ein entsprechendes Datenschutzniveau gew\u00e4hrleisteten.<\/p>\r\n

Erforderliche Datentransfers:<\/strong><\/h4>\r\n

Eine \u00dcbermittlung darf dennoch erfolgen, wenn diese oder die sonstige Verarbeitung von Daten erforderlich<\/em> und f\u00fcr Betroffene erkennbar ist. Dies ist der Fall, wenn beispielsweise eine Reise in die USA gebucht oder eine E-Mail dorthin verschickt wird.<\/p>\r\n
